We know that you value how your personal information is used and acknowledge the importance of protecting your privacy. This Privacy Policy explains how we collect, use and disclose your personal information. You are not obliged to provide any personal information requested. However, if you elect not to, we may not be able to provide you with a complete range of services.

In this Privacy Policy, “we”, “our” and “us” refers to VHG Hotels Management (ABN 49 583 748 377), its subsidiaries, and its affiliated entities and partnerships, together VHG or the Group.  The expressions “you” and “your” and the “customer” refer to each and every individual whose personal information we may handle from time to time.

The Group’s portfolio includes operated or managed properties and businesses, as well as licensed hotels. Any licensed hotels are operated by entities that are separate from the Group. To determine the data controller for guest data under a licensed hotel, please contact the hotel directly. We may from time to time update this Policy to ensure that it remains consistent with the business and services we offer and any changes to legal or regulatory requirements.

1. Personal Information and Our Privacy Commitment
Personal Information includes any information relating to, describing, reasonably capable of being associated with, or capable of reasonably being linked, directly or indirectly, to an identified or identifiable natural person.

We are aware of the importance of, and are committed to, managing any Personal Information we may collect from you. The purpose of this Privacy Policy is to provide you with transparency about our collection, usage, maintenance, storage and destruction of Personal Information.

2. How do we collect personal information?
Where possible, we collect your Personal Information directly from you, in accordance with applicable law. This collection may include when:

  1. you interact with us on our websites or the investor portal;
  2. you communicate with us via email, phone or social media;
  3. visit our website, social media channels or access our app;
  4. use the Internet connection, networks, telecommunications systems and/or information processing systems at our properties;
  5. visit our properties, through CCTV recordings placed in public areas;
  6. when you interact with any of our employees either in-person or online;
  7. participate in a membership or loyalty program; and
  8. authorise a third party to interact with us on your behalf in any manner e.g. make, change or enquire about a reservation on your behalf.

We may collect your Personal Information from third parties or public agencies to verify any information you provide or in instances where it would be impracticable or unreasonable for us to collect the Personal Information directly from you. Any information we collect from third parties will be done in a fair and lawful manner and is considered reasonably necessary for our functions or activities.

If you provided us with the personal data of a third party after receiving authorisation to do so, you represent to us that you have obtained the consent of the third party to provide us with their personal data for the respective purposes.

3. What personal information do we collect?
The Personal Information we collect differs dependent upon the purpose of collection and the services we are providing to you. We will retain the information provided, unless we explicitly advise you otherwise. Generally, we collect the following types of personal information from you:

  1. contact information, such as your name, email address, physical address and telephone numbers;
  2. demographic information, such as your age and gender;
  3. payment information in connection with a reservation or additional products or services purchased during your stay or visit;
  4. information related to your reservation, itinerary and other travel-related
  5. information, including information about your companions;
  6. information related to your stay at or visit to our property, including your feedback and opinions about our properties and services;
  7. information on your usage of and interaction with our website;
  8. videos and images collected through Closed-Circuit Television (“CCTV”) recordings; and
  9. any other information you voluntarily provide to us.

There will be certain occasions where we will collect additional personal information. Where you apply for employment with us, we may collect additional personal information such as employment history, educational history, and employment references.

Any unsolicited personal information you provide us with, will be assessed to determine whether such information is reasonably necessary for one or more of our functions or activities.  The unsolicited personal information you disclose to us may be used and disclosed for the purpose for which you supplied such information or where you would reasonable expect us to. We may also disclose or use the information for alternate purposes with your consent or as may be required by law.

We may also collect personal information about third parties from you, such as family members, so we can provide services to those third parties. You must ensure that any third-party individual you provide personal information about, is aware of this Privacy Policy, understands it and agrees to accept it. If the third-party individual you provide personal information about does not have the capacity to understand and agree to the terms i.e. is a minor, we require a parent or guardian to acknowledge and agree to this paragraph. 

4. Why do we collect and use your personal information?
The Personal Information we collect depends on the nature of the relationship we have with you. Generally, we will collect your Personal Information to provide you with the services you have requested, including without limitation, for the following purposes:

  1. customer care such as processing payment for services provided, dealing with enquiries, requests and assessing and handling complaints;
  2. where it is necessary for the adequate performance of our contract with you:
    1. Reservation, booking or other related information. Provide you with the services you require, such as to facilitate your reservations, your booking of facilities, or to assist you with meetings, event planning or travel arrangements;
    2. Contact information. Send you pre- and post-stay/event/activity communications and satisfaction surveys; communicate with you on other administrative information in relation to our services;
    3. Identification information. Verify your identity for the purpose of providing you with our services;
    4. Payment information. Facilitate and/or process your payments for the services you require;
    5. Request for information. We process your information to assist you with your requests, queries and complaints, whether sent to us online, through paper forms, or in person; and
    6. Compliance. Comply with applicable legal and regulatory obligations in relation to our contract with you.
  3. We process your information given our legitimate interest in safeguarding and improving our properties and in continuously striving to provide a better level of service to you. We may use and disclose your Personal Information for the following purposes:
    1. Guests’ preferences and interests. Offer recommendations that may be of interest to you; improve and customise your experience for current and future stays at our properties;
    2. Guests’ reviews and opinions. Allow us to measure how well we have served you; respond to your feedback, queries and complaints; help us continuously improve our properties and services.
    3. Statistical Research. Conduct market and statistical research in order to better understand customer preferences and demographics, and to improve our properties and services.
  4. We process your information given our legitimate interest in maintaining the proper functioning and security of our digital and physical facilities. We may use and disclose your Personal Information for the following purposes:

    Improve and optimise the functioning of our website and app, such as by performing analytics and conducting research;

    1. Maintain the safety and security of our properties, facilities and employees;
    2. Ensuring network and information security; and
    3. Implementing fraud prevention.
  5. Where you are our existing guest or customer, we process your information given our legitimate interest in undertaking marketing activities to promote properties and services. We may use and disclose your Personal Information for the following purposes:
    1. Send you promotions, sales, offers, events, competitions and/or activities, and other information about us and/or our trusted partners that may be of interest to you;
    2. Personalise, measure and improve our advertising;
    3. Conduct profiling on your characteristics and preferences to send you tailored marketing content; and
    4. Participate in our branding activities (including without limitation, the publication of your image, written quotes and testimony audio and video recordings for the purpose of promoting our company or companies, and our community).

5. Who do we disclose your personal information to?
In the conduct of business, we may disclose your information to third parties. This may include without limitation, disclosure:

  1. to employees, related bodies corporate, agents, contractors or service providers for the purposes of operating our business, fulfilling your requests and providing you with services;
  2. to suppliers and other third parties where we have established commercial relationships (including outsourced and cloud service providers) for business, marketing, maintenance, distribution of services and related purposes;
  3. with your specific and prior consent, to other companies or individuals for the purposes you have consented to; and
  4. where we consider in our absolute discretion, we are required to disclose the information in order to satisfy any applicable law, regulation, legal process or government request.

Some of our related bodies corporate, contractors and/or services providers may be located overseas. By disclosing your Personal Information to these parties, your Personal Information may be transferred overseas. Any organisations which we disclose your Personal Information to locally or overseas, are subject to reasonable contractual obligations to safeguard and protect your Personal Information and comply with all privacy laws.



6. How is your personal information secured?
Reasonable steps will be taken to protect your Personal Information from any misuse, interference, loss, unauthorised access, modification or disclosure. We maintain physical and electronic security over our paper and electronic data storage as well as computer and network security.

Subject to applicable privacy laws, we will either destroy or permanently anonymise your personal information when it is no longer needed for its purpose and it is not required to be retained by law.

We also take precautions to ensure that Internet and other technology services which we provide at our properties are secure. Subject to any applicable law, we may monitor the use of our Internet connection(s), wireless or cable networks, telecommunications systems and/or information processing systems to enable us to detect and counter any security breaches.

7. Access To And Correction Of Personal Information
It is your responsibility to ensure the information we hold about you is accurate, current, complete, relevant and not misleading.

Where you have direct access to your Personal Information, you will be required to adhere to prompts to access, correct or update your Personal Information.
Alternatively, you can access or correct your Personal Information or Personal Information we hold about a minor or child you have legal authority to represent, by contacting us through the ‘Contact Details’ disclosed below.

There may be circumstances where we may refuse your request to access, or correct, your Personal Information. If that is the case, we will provide you with reasons for that decision unless it is unreasonable for us to do so. We take reasonable steps to ensure Personal Information we use is accurate, complete and current including updating Personal Information when we are advised by you that your Personal Information has changed. We are determined to respond to all requests for access and/or correction within a reasonable time.

8. Direct Marketing
We may rely on your Personal Information to send you direct marketing communications and information about our services that we may consider to be of interest to you. These communications may be sent in various forms, including mail, SMS and email, in accordance with applicable marketing laws. You consent to us sending you direct marketing communications through any of those methods.

If a preferred method of communication is indicated, we will endeavour to use that method when practical. In addition, you may opt out of marketing communications at any time by contacting us (through the ‘Contact Details’ disclosed below) or by using opt-out facilities provided in marketing communications.

9. Consent
Where any information has been submitted by you or any person authorised by you to act on your behalf which may be relevant for disclosure for any of the purposes or under any of the circumstances set out above in the sections above, the submission of such information to us constitutes consent by you to our disclosure and use of such information for such purposes or under such circumstances, and consent to the handling of your information in accordance with the terms of this Privacy Policy.

VHG strives to keep all our guests and visitors informed about VHG special offers and enhancements, and those offered by our strategic marketing partners. However, certain data privacy regulations may require us to obtain your permission before we send you information that you have not requested from us.

In some cases, your permission will be implied from the nature of the service requested or transaction undertaken. For example, VHG may collect and use personally identifiable information provided by you or related persons to facilitate or effect transactions with VHG or its Affiliates, or behavioural data or information collected in the aggregate. In addition, your permission will be deemed given for communications from us that are necessary to fulfil transactions and services that you request.

10. Use of Cookies
When you use our website, we may use analytic tracking via a third party to gather information about how the website is used. A “cookie” is a small piece of information, or file that a website sends to your computer’s hard drive while you are viewing that website for record keeping purposes. If you do not wish to receive any cookies you may change your browser settings to block them. This may mean you might not be able to take full advantage of the website.

The information collected from cookies is used for numerous reasons, including without limitation:

  1. 

To measure traffic patterns and determine which parts of our website have been visited;

  2. To recognise your computer and avoid requesting you to register or log-in again; and
  3. To administer the website and analyse trends.

11. Anonymity and use of a pseudonym
You may request to deal with us anonymously or through a pseudonym. To the extent that it is lawful and practical for us to do so, we will grant such a request. Although, we may not be able to provide a complete range of services where you elect to do so.

Besides the use of a pseudonym, all other information shared must be true and correct.

12. How to make a complaint
Any complaints about the way in which we handle your personal information should be directed to our Privacy Officer using the ‘Contact Details’ disclosed below. We will investigate any complaint promptly and will respond to written complaints within a reasonable time from the date of receipt.  If you are dissatisfied with our response, you may refer the matter to the Office of the Australian Information Commissioner for guidance on alternative courses of action that may be available (refer to https://www.oaic.gov.au).

13. Your lawful rights
Each jurisdiction grants certain lawful rights in respect of your Personal Information. In some jurisdictions, additional rights may be available to you – these are outlined in Schedule A.

14. Changes to the policy
This Privacy Policy may be modified from time to time to accommodate for changes in the law and/or our business needs. Any revisions to this Privacy Policy will be effective as of the revision date specified at the end of this Policy. We encourage you to periodically review this Privacy Policy.

Schedule A: Additional Privacy Requirements For European Union (EU) residents, the following additional rights apply globally:

Right to erasure – you have the right to require us to delete your information if our continued use is not justified. However, this will need to be balanced with other factors. Depending on the type of personal information we hold about you and why we have collected it, there may be some legal and regulatory obligations restricting us from complying with your request.

Right to restrict processing – in some circumstances, you may be entitled to limit the purposes for which we can use your information.

Right of data portability – you have the right to require us to provide you with a copy of the personal information that you have supplied to us in a commonly used machine-readable format or to transfer your information directly to another controller (e.g. a third party offering services competing with ours). Once transferred, the other party will be responsible for looking after your personal information.

Right to withdraw consent – for certain limited uses of your personal information, we may ask for your consent. Where we do this, you have the right to withdraw your consent to further use of your personal information. If you withdraw your consent, we may not be able to provide certain services to you.

In some circumstances exercising some of these rights will mean we are unable to continue providing services to you.
